Northern Marianas: Case against Lina’La Sin Casino now moving forward with scheduling
The slander case filed by a Hawaii resident against Jackie Marati and Lina’La Sin Casino is moving forward with the court’s order requiring both parties to submit a proposed scheduling order and discovery plan by March 17.
District Court of Guam deputy clerk Francine Diaz has set a scheduling conference for the case on April 1 at 9 a.m.
The case filed by Hoolae Paoa before the District Court of Hawaii was transferred to Guam by the defendants.
Marati, the spokesperson of Lina’La Sin Casino, and several John Does of the gambling opposition were sued by Paoa on August 4, 2006 for defamation, invasion of privacy, and intentional infliction of emotional distress.
The Hawaii resident complained that Marati and Lina’La Sin Casino caused him some harm when the gambling objectors issued a press release and named the plaintiff and other individuals in fraudulent gambling schemes.
According to the plaintiff, he was identified by Marati’s group as one of the slot machine legalization proponents, describing him as a convicted felon with a history of convictions since 1978.
Paoa said the statements caused injury to his personal and professional reputation in Hawaii.
On Oct. 17, 2007, Marati moved to transfer the venue of the case to Guam, which was opposed by the plaintiff.
The Hawaii magistrate judge recommended the transfer after agreeing that Guam is more familiar with the governing law, the location is more convenient for the witnesses, and there is easier access to the sources of proof.
